2. Scope and acceptance
These terms govern the distance selling of food products and gift boxes through this site. They apply to all orders and must be read and accepted before completing your purchase.
If you buy as a consumer, that is for purposes outside your business or professional activity, the protections of the Italian Consumer Code (D.Lgs. 206/2005) apply in your favour. If you buy with a VAT number for resale or for professional use, the terms that apply are those of the wholesale channel: you will find them on the page wholesale.
The seller may update these terms: the version published at the time the order is sent always applies to that order.
3. How to place an order
- Choose the products and add them to the cart. The minimum order is 25 €: below this threshold the purchase cannot be completed.
- Enter your delivery and billing details and choose the payment method.
- Check the summary, which shows the products, quantities, total price, any delivery charges and shipping details.
- Confirm the order with the button that expressly states the obligation to pay.
Until you confirm, you can correct every detail you have entered by going back through the cart steps.
4. When the contract is concluded
The contract is concluded when the seller accepts the order, that is when it sends the customer the confirmation email with the order number and the summary. The email is sent to the address given at the time of purchase: if you do not receive it within 24 hours, check your junk folder and then write to us.
The seller may refuse an order, informing the customer, where the product is no longer available, the delivery details are incomplete or clearly wrong, the payment has failed, or the quantities are not compatible with a sale to a final consumer. In these cases any sums already charged are refunded.
5. Products, photos and availability
The products are worked by hand in small batches in the workshop in Brugnera, with selected raw materials and with no added colourings, preservatives or gelling agents. Colour, texture and the intensity of the aroma can vary from one batch to the next: this is a normal result of working in small quantities with fresh raw materials, not a defect.
The photographs are indicative and serve to show the product: small differences in shade compared with the jar you receive are not a fault. Ingredients, allergens, net weight, nutritional values and the best before date are given on each product page and on the label of the jar. The label always prevails.
Some items are seasonal and depend on the availability of the fruit, so they can sell out or become available again during the year. If a product sells out after the order has been sent, the seller informs the customer and offers a replacement or a refund of the part not supplied.
6. Prices and VAT
All prices are in euro and include VAT at the rate set by law. The total due, including any delivery charges, is always shown in the summary before you confirm.
The seller may change the prices at any time: the price published at the time the order is sent applies. If a price is clearly wrong because of an obvious system error, the seller informs the customer before processing the order and the customer can confirm at the correct price or cancel at no cost.
An invoice is issued on request, by giving the necessary details when placing the order. The document is sent by email in the manner provided for by the rules on electronic invoicing.
7. Payments
Only the payment methods shown in the Shopify checkout are accepted. Cards and other payment instruments are handled by the providers indicated during payment. Advance bank transfer and payment on collection are available only if expressly shown in the checkout.
8. Alcoholic drinks and legal age
Alcoholic drinks are not for sale to anyone under 18.
The catalogue includes liqueurs and products containing alcohol. When the order is placed, confirmation of age is requested: the buyer declares that they are 18 or over. The seller may refuse or cancel an order when this confirmation is missing or when there are grounds to doubt that the buyer is of legal age.
On delivery the courier may ask for an identity document and may refuse to hand over alcoholic products to anyone under 18. If delivery cannot be made for this reason, the rules that apply are those on the page shipping and delivery.
9. Shipping and delivery
Shipping within Italy is free, with a minimum order of 25 €; to the other European countries we serve it costs 15.00 €. Delivery normally takes 24/48 hours from dispatch. Orders sent by 12 noon are dispatched the same day, Monday to Friday; from October to December, because of the workload in that period, same-day dispatch is not guaranteed.
Times by area, the courier, the handling of parcels held at the depot and the rules for the islands and remote areas are described on the page shipping and delivery, which forms an integral part of these terms.
The risk of loss or damage passes to the consumer customer only when the parcel is physically delivered.
10. Right of withdrawal
The consumer customer has 14 days to withdraw from the purchase, without having to give a reason. The period runs from the day the parcel is received.
Withdrawal does not apply to perishable goods or to sealed goods which are not suitable for return for reasons of hygiene or health protection, once they have been opened. Sealed food products therefore cannot be returned once opened. The procedure, the return address, the costs and the refund times are described on the page withdrawal, returns and refunds.
11. Legal guarantee of conformity
Consumer customers are covered by the legal guarantee of conformity provided by the Italian Consumer Code. As these are food products with a best before date, any lack of conformity must be reported as soon as it is noticed and in any case by the date shown on the label.
If a product arrives broken, spoiled or different from the one ordered, the customer is entitled to a replacement or a refund at no cost, following the procedure described on the page withdrawal, returns and refunds.
12. Complaints and support
For any problem with an order you can write to info@alessiobrusadin.it or use the contact details on the page contacts, quoting the order number.
13. Liability and force majeure
The seller is liable for damage caused by its own breach within the limits set by law. No clause in these terms limits the rights that the law gives the consumer.
The seller is not liable for delays or failed deliveries due to causes beyond its control, such as extraordinary weather events, strikes, traffic restrictions or measures taken by the authorities. In these cases the seller informs the customer and agrees a new delivery or a refund.
14. Personal data
The data collected for the order is processed to manage the purchase, delivery, invoicing and support. The purposes, the legal bases, the recipients and the retention periods are described in the privacy policy. The use of cookies is described in the cookie policy.
15. Applicable law and disputes
The contract is governed by Italian law. For consumer customers, the mandatory rules of the country where they habitually reside still apply.
For disputes with a consumer, the court of the place where the consumer resides or is domiciled has jurisdiction.
The consumer may also use the competent ADR bodies provided for by law.
16. Changes to these terms
These terms may be updated for legal reasons or because of changes to the service. The updated version is published on this page with the date it was last updated. Orders already confirmed remain governed by the version in force when they were sent.
